These are the terms and conditions of Ala K. Design House (“Ala K. Design House”) and our website http://www.alakdesignhouse.com (“Website”).

Ala K. Design House’s main registered office is 47 Al-Shariaah College Street, Amman, in the Hashemite Kingdom of Jordan (“Jordan”). Ala K. Design House is registered to the Ministry of Industry, Trade and Supply of Jordan under the n°275184.

In France, Ala K. Design House is represented by Mr. Frédéric TURLIN – EI – (RCS number 839 281 276, VAT number FR96 839281276, Phone number +33 7 83 05 50 39), at 12 Rue des Filles du Calvaire, 75003 PARIS.

These terms fall under Jordanian law and the jurisdiction of the Jordanian courts.

This page, together with the documents expressly referred to within it, state the legal terms and conditions (‘Terms’) under which you may use any of our products. By placing an order for any products (‘Products’), you agree to be bound by these Terms. If you do not agree to these Terms, please refrain from ordering via our website.

These Terms will apply to any contract for the sale of Products by us to you (the ‘Contract’). Before you proceed to place your order, kindly peruse these Terms with care and make sure to keep a copy for future reference.

Please be aware that, prior to confirming your order, you will be required to consent to these Terms. If you have any inquiries pertaining to these Terms, please reach out to us. It’s important to note that our customer service team is proficient in Arabic, English and French.

We retain the right to modify these Terms at any given moment by updating this page. We recommend revisiting this page periodically to familiarize yourself with the current Terms since they are legally binding for you. Whenever you purchase products from us, the Terms in effect at that time will govern the contractual agreement between you and us.

Contract with Ala K. Design House

When you place an order on our website, you will be directed through the ordering process with a set of straightforward instructions. Please take a moment to carefully review and confirm your order at each step of the process. You will have the opportunity to double-check your order and correct any mistakes before finalizing it.

To complete your order and proceed with the purchase, simply click on the ‘Pay now’ button. Once your order is placed, you will promptly receive an email confirmation from us, confirming that we have received your order and outlining the order details.

By making a purchase, you confirm that you have the legal capacity to enter into a binding contract with us. You are only eligible to buy products from our websites if you are at least 18 years old.

In the event that we are unable to provide you with a product – for instance, if the product is out of stock, no longer available, if there’s a pricing error on the Ala K. Design House website, or if we cannot obtain authorization for your payment – we will promptly notify you via email, and your order will not be processed. If you have already made a payment for the products, we will promptly refund the full amount.


Description and price of products

We take diligent measures to ensure the accuracy of all product details, descriptions, and prices on our website when they are initially entered into our system. While we strive to maintain the website’s timeliness, the information, including product descriptions, available on the website at a given moment may not always align with the status when you place your order.

Please note that the product images displayed on the website are for illustrative purposes only. Despite our best efforts to depict colors accurately, we cannot guarantee that your computer, tablet, or mobile phone will display these colors precisely to reflect the actual product colors. There may be slight variations between the images and the actual products.

Our website offers a wide array of products, and despite our reasonable efforts, occasional pricing errors may occur for some items. The price of a product cannot be confirmed until your order is officially accepted by us.

In the event we identify a pricing error for the product you’ve ordered, we will promptly notify you of the error and provide you with the choice of proceeding with the purchase at the correct price or canceling your order. We will not proceed with processing your order until we receive your instructions. If we are unable to contact you using the provided contact details from the order process, we will consider the order canceled and notify you in writing. Please be aware that we are not obliged to provide the products at the incorrect price.

Prices for our Products may change from time to time.

The cost of a product encompasses the Value Added Tax (VAT) at the prevailing rate, if applicable, as per the regulations in the country of purchase. Nonetheless, should the VAT rate change between the time of your order and the date of delivery, we will modify the VAT amount you pay, unless you have already settled the full payment for the products before the VAT rate alteration.

It’s important to note that the product price does not encompass delivery fees, which you are responsible for in addition to the product cost. The delivery charges are explicitly provided during the ordering process and are disclosed prior to finalizing your order.


Payment

For all online purchases, we utilize the services of a payment provider. We do not have access to your card details at any point. If you encounter any issues related to payments, please direct all correspondence to the payment provider.


Your right to cancel

If you are a consumer, meaning you are entering into the contract for a purpose unrelated to your trade, business, or profession, you have the legal right to cancel the contract within 4 days from either the date of purchase if you bought the product from a physical shop, or from the date of delivery if the purchase was made through the website. This means that during this specified period, if you change your mind or decide not to retain a product for any reason, you can notify us of your decision to cancel the contract, and we will issue a refund.

Please note that this right to cancel does not apply to products that have been personalized to your specific requirements.

To cancel a contract, you must provide us with a clear statement of your decision to cancel. You can do this only by sending an email to team@alakdesignhouse.com. The cancellation becomes effective from the date you sent the email to us. 

It’s advisable to keep a copy of your cancellation notification for your own records.

Please be aware that any subsequent phone calls may be recorded for quality and training purposes. Also, our customer service team is proficient in Arabic, English and French.


Effects of cancellation

If you decide to cancel the contract, we will reimburse all the payments you’ve made to us under the contract, excluding any delivery charges.

The refund will be processed promptly and, in any case, no later than 14 days after we have received the product(s) from you. We will issue the refund using the same payment method that you initially used for the product(s) purchase. You will not be subject to any fees as a result of the refund.


Returns procedure

After we have received your request for returns, kindly ship the product(s) back to our shop address using the services of an international logistics carrier, and be sure to provide us with the tracking information so that we can monitor the return of the product. Please note that you will be responsible for covering the cost of returning the product.

If the value of the product has been diminished due to your handling of it beyond what is necessary to understand its nature, characteristics, and functioning, we reserve the right to recover that amount from you. This amount may be deducted from any refund that we issue to you.

It’s important to emphasize that your right to cancel is not dependent on complying with these requests, but adhering to them will assist us in expediting the refund process.


Defective products

We have a legal obligation to provide you with products that meet specific quality, suitability, and conformity criteria defined in our contract with you, referred to as ‘Expected Standards.’ We make reasonable efforts to ensure that our products meet these Expected Standards, taking into account all relevant factors related to their nature and manufacture. Products that do not meet these Expected Standards are considered ‘defective’ in the context of explaining your entitlement to a replacement or refund, as outlined below.

We are committed to maintaining high standards of materials and workmanship. If you receive any products from us that exhibit defects in materials or workmanship at the time of dispatch or do not meet the Expected Standards as previously described, you should notify us in writing within 3 days of delivery. You can use the contact information provided below in the Contact section.

Upon receiving such notification, and if necessary, returning the defective products, you will have the option to receive replacement products at no additional cost (where applicable), or we will offer you a refund for the affected products, as detailed in the ‘Refunds Procedure for Defective Products’ section below. We will provide replacements within a reasonable timeframe and without causing substantial inconvenience to you. If you choose to receive a replacement, this 3-day period is paused to allow you to receive the replacement and confirm its acceptability.

Our policy for replacement or refund of defective products does not cover the following situations:

  • Any defect in the products resulting from (i) Normal wear and tear, (ii) Deliberate damage, improper handling or storage, misuse, accidents, negligence by you or any third party, (iii) Use of the products in a manner not recommended by us and/or failure to follow our instructions, (iv) Incorrect information or specifications provided by you.
  • Products for which you have not completed the payment.

Please note that you are legally obligated to retain the products in your possession and exercise reasonable care in safeguarding them during the time they are in your possession.


Refunds for defective products

When we issue a refund for the price of any defective products or those that do not meet the Expected Standards, we will provide a full refund of the product’s price. The refund will be processed promptly, and in any case, no later than 14 days after we have acknowledged your entitlement to a refund.

We will direct our payment provider to refund the amount to the credit card or debit card you used for the initial payment.

Please be aware that our returns and refunds policy does not undermine your statutory rights.


Risk and title

Starting from the moment of delivery to you, you will assume responsibility for the products and any potential loss or damage to them.

Ownership of the products will transfer to you once we have received full payment, which includes all relevant delivery charges.


Intellectual property

We own or hold the licenses for all intellectual property rights associated with the Ala K. Design House website and its content. This includes, but is not limited to, all images, designs, logos, photographs, and written text found on the site. These creations are safeguarded by copyright, trademarks, and other intellectual property rights, and all such rights are safeguarded. Unauthorized utilization of these intellectual property rights is strictly prohibited.


Modification of ‘access points’ and links

We categorize access points as comprising our website, email communications, newsletter, and social media channels. Our objective is to maintain the website with regular updates, and we retain the right to modify its content at any point. If circumstances necessitate, we may temporarily suspend access to the website or discontinue it permanently.
